D.C. Code § 32-702 (2014)
§ 32-702. Domestic partnership registration and termination procedures
(a) To establish the existence of a domestic partnership
and to qualify for benefits under §§ 32-704, 32-705, and 32-706, persons shall
register as domestic partners by executing a declaration of domestic
partnership to be filed with the Mayor. For the purposes of this section, the
declaration shall be signed by the domestic partners and shall affirm under
penalty of perjury that each domestic partner:
(1) Is at least 18 years old and
competent to contract;
(2) Is the sole domestic partner of
the other person; and
(3) Is not married.

D.C. Code § 46-401 (2014)
§ 46-401. Equal access to marriage
(a) Marriage is the legally recognized union of 2
persons. Any person may enter into a marriage in the District of Columbia with
another person, regardless of gender, unless the marriage is expressly
prohibited by § 46-401.01 or § 46-403.
On December 1, 2009 the Religious Freedom And Civil Marriage Equality Amendment Act 2009 passed by a vote of 11-2 on the first reading. The second reading was voted on December 15, 2009. The measure passed by a vote of 11-2. The bill has received the Mayor's signature and was not successfully challenged during the "30 day Congressional review period." Thus, the bill became law effective 3 March 2010. Same-sex marriages are now performed in the District of Columbia.[103]
